Legal Fee Loans for Family Law and Estate Matters

Financing Your Legal Matter

Legal fee financing can help eligible clients fund legal costs. In Family Law, Estate matters and inheritance advances, legal costs can feel like just one more worry … at a time when you already have more than enough on your plate.

We know that needing legal assistance rarely comes at a convenient moment. And, even when you have assets or money eventually coming to you, it doesn’t mean you can access it when costs need paying.

At Falzon Legal, we never want the immediate expense of getting legal advice to be the reason you never find out where you stand, or what you can do about it. Depending on your circumstances and the type of matter involved, there could be several ways to manage your legal costs.

Legal Fee Funding Through JustFund

For eligible Family Law, separation and Estate matters, JustFund offers flexible funding that can help cover the cost of legal representation.

How Does JustFund Work?

Unlike a standard personal loan, which would typically look at your income, employment, and credit score, JustFund takes into account your legal matter. It examines the assets or entitlements you’re expecting to receive when it’s all over, instead of depending on traditional lending criteria.

If you’re approved, then the funding can go towards your legal fees and related costs as they come up: potentially including barristers, expert reports, and court expenses. What’s more, the actual repayment is generally put off until your matter ends, subject to the terms of your funding agreement.

This can give priceless peace of mind, meaning you can move forward with your legal matter without having to find the full cost of representation straight away.

What Legal Matters Can JustFund Cover?

JustFund can take care of the cost of eligible Family Law property matters and estate disputes. That said, parenting-only cases generally aren’t covered, though funding may be available if parenting and property are being resolved at the same time.

Eligibility, the amount available, interest, fees, and repayment terms are all set by JustFund, all based on your individual circumstances.

Monthly Payment Arrangements

We know that paying legal fees in one go may not always be possible.

Depending on your legal matter and individual circumstances, there could be options that mean your legal costs could be spread over manageable monthly payments, instead of a single lump sum.

Other Legal Fee Loan Options

Harmoney

Harmoney offers unsecured personal loans, up to $100k, that may potentially be used towards legal expenses. Applications are subject to Harmoney’s eligibility requirements, approval process, borrowing limits, interest rates and other lending terms.

OMM Personal Loans

OurMoneyMarket (OMM) also provides unsecured personal loans for up to $75k that you could use to meet legal and other expenses. The amount available and the cost of borrowing will depend on OMM’s eligibility requirements, assessment, and current lending terms.

When Legal Fee Funding Might Help

Funding tends to make the most difference when money is tied up in your legal matter. A few situations we often see:

Legal Fee Funding
  • Your wealth is sat in property or other assets – you might have significant equity but limited access to cash while your legal issue is being resolved.
  • You don’t currently have access to shared finances – maybe, after a separation, one person may have considerably greater access to the family’s money than the other.
  • You’re involved in an Estate dispute – you may be bringing or defending a Family Provision Claim or other inheritance dispute, while the Estate and your entitlements aren’t yet distributed.
  • Legal costs are due before money becomes available – your matter may require advice, negotiation, mediation, or expert evidence now, even though the funds you expect to get won’t be available for a while.

In situations like these, financing can be a powerful way to meet legal costs now and repay them later. But, that doesn’t always make it the right choice for you.

A Note Before You Decide

Legal fee funding is still borrowing, and borrowing comes at a cost. Depending on the provider and their product, interest, fees and other charges will increase the overall amount you repay

That’s why it’s crucial to understand not just how much funding is available, but also what it will actually cost you, and when it all needs to be paid back.

Third-party funding products are arranged independently of Falzon Legal, with eligibility, rates, fees, and lending terms all set by the relevant provider.

Read their terms carefully, and always consider getting independent financial advice, particularly if you’re unsure whether a given arrangement is suitable for your circumstances.
